SB 439 - This act revises various crimes involving firearms. The act increases the minimum time required to be served prior to parole for armed criminal action, from 3 years to 5 years for the first offense and from 5 years to 7 years for a second offense. The act also deletes a reference to repealed sections.
The crime of unlawful use of a weapon shall include persons who carry a firearm while unlawfully possessing controlled substance. The act creates "Project Exile", a program requiring the state to review certain weapons offense cases for the possibility of federal prosecution, if it appears that federal prosecution is reasonably likely to result in more restrictive bail, stricter enforcement or greater penalties. The Attorney General shall be notified of and maintain a record of the program's investigations and prosecutions.
The act is similar to HB 2103 (2000).
